Asunto: <\/span>Aviso 5\/2008 de RR.HH. Unidad de Prevención y Salud Laboral.<\/span><\/strong><\/span><\/strong><\/p>\n

Inclusión de un apartado ilegal<\/span><\/strong><\/span><\/p>\n

 <\/span><\/p>\n

Según este aviso, de fecha 19\/12\/2008, en su página 5ª, apartado 5º En caso de asistencia a consulta médica especialista dentro de la jornada laboral, párrafo Condiciones retributivas, se establece:<\/span><\/p>\n

<\/div>\n

”No se producirá pérdida de retribuciones siempre que el tiempo empleado no exceda de 4 horas por jornada de trabajo y se cumplan las formalidades”.<\/span><\/em><\/p>\n

<\/div>\n

La inclusión de este párrafo es ilegal, porque existen sentencias judiciales firmes que así lo estiman. <\/span><\/p>\n

<\/div>\n

Sirva como ejemplo la sentencia del Juzgado de lo Social nº 38 de Madrid, que ha dado la razón a un compañero de Solidaridad Obrera <\/strong>que demandó a la empresa por esta práctica abusiva. Y ha sentenciado que será abonable el tiempo considerado racionalmente como indispensable, por lo que se considera como improcedente el límite puesto por la <\/strong>empresa en 4 horas.<\/strong> El carácter retributivo de estos permisos se basa en una resolución de la Delegación Provincial de Trabajo de Madrid del año 1972.<\/span><\/p>\n

<\/div>\n

Por todo ello, exigimos<\/u> a la empresa que respete la legalidad y la jurisprudencia. Y anule ese párrafo de su aviso, poniendo en su lugar el Fallo de la referida sentencia, de la que es perfectamente conocedora. Y comunique a los trabajadores este significativo cambio en la redacción.<\/span><\/p>\n
