{"id":7563,"date":"2019-10-02T12:23:18","date_gmt":"2019-10-02T12:23:18","guid":{"rendered":"https:\/\/www.solidaridadobrera.org\/confederal\/?p=7563"},"modified":"2019-10-08T10:57:30","modified_gmt":"2019-10-08T10:57:30","slug":"aviso-87-2019-metromadrid-de-una-imputacion-anunciada-solidaridad-obrera-se-persona-como-acusacion-particular-en-el-proceso-del-amianto","status":"publish","type":"post","link":"https:\/\/www.solidaridadobrera.org\/confederal\/2019\/10\/02\/aviso-87-2019-metromadrid-de-una-imputacion-anunciada-solidaridad-obrera-se-persona-como-acusacion-particular-en-el-proceso-del-amianto\/","title":{"rendered":"AVISO 87\/2019 METROMADRID \u2013 DE UNA IMPUTACI\u00d3N ANUNCIADA &#8211; SOLIDARIDAD OBRERA SE PERSONA COMO ACUSACI\u00d3N PARTICULAR EN EL PROCESO DEL AMIANTO"},"content":{"rendered":"\n<p><strong>CR\u00d3NICA DE UNA IMPUTACI\u00d3N ANUNCIADA<\/strong><\/p>\n\n\n\n<p><strong>SOLIDARIDAD OBRERA SE PERSONA COMO <\/strong><strong>ACUSACI\u00d3N PARTICULAR<\/strong><strong> EN EL PROCESO DEL <\/strong><strong>AMIANTO<\/strong><strong><\/strong><\/p>\n\n\n\n<p><strong>Solidaridad\nObrera<\/strong> viene exponiendo lo que, al final, se\nha cumplido: <strong><em>la Juez imputa a los acusados por la Fiscal\u00eda de los delitos de\nhomicidio imprudente, lesiones y contra los derechos de los trabajadores<\/em><\/strong>.\nEsto confirma que la actitud y actividad de los responsables de la direcci\u00f3n de\nMetro de Madrid ha sido, \u201cpresuntamente\u201d delictiva, y aqu\u00ed vienen las primeras\nconsecuencias: imputados, investigados, y sobre todo una gran historia por\ndesenmara\u00f1ar, los graves delitos cometidos contra los trabajadores de Metro de\nMadrid y contra los usuarios de este medio de transporte p\u00fablico. No se\ndescarta que durante las pesquisas judiciales otros responsables cambien su\nsituaci\u00f3n de testigo o investigado a imputado.<\/p>\n\n\n\n<p>Los\ndelitos est\u00e1n tipificados en el c\u00f3digo penal de diferentes formas y deben ser\njuzgados; se han cometido en el pasado y en el presente se contin\u00faan\ncometiendo. En concreto en asuntos como la Vigilancia de la Salud, que la\nmantienen voluntaria, a sabiendas de que debe ser obligatoria. O en el trabajo\ndiario sin protecci\u00f3n alguna, con materiales con amianto que se siguen\n\u201cdescubriendo\u201d.<\/p>\n\n\n\n<p>Solidaridad\nObrera acumula innumerables denuncias a la Inspecci\u00f3n de Trabajo, trata asuntos\nen los Plenos del Comit\u00e9 de Seguridad y Salud, remite escritos a los\nresponsables exigiendo explicaciones y medidas de prevenci\u00f3n y protecci\u00f3n, etc\u2026\ncasi todo ha derivado en incumplimientos, trabas y desidia por parte de estos\nresponsables para afrontar el problema y eliminarlo, m\u00e1s bien al contrario, han\nnegado la mayor, como si no reconocer el problema lo hiciera desaparecer.<\/p>\n\n\n\n<p>Todas\nestas actuaciones y los problemas que han ido provocando en los \u00faltimos a\u00f1os, nos\nlleva a pensar que las imputaciones, responsabilidades, etc. no se pueden\nquedar solo en estas ocho personas. <\/p>\n\n\n\n<p>Desconocemos\nel alcance que tendr\u00e1 el proceso, ni si todos los implicados en la gesti\u00f3n de\neste problema han podido trabajar con libertad, o si las decisiones, al final,\nson exclusivas de los m\u00e1ximos responsables de esta empresa, altamente\nprotocolarizada y jerarquizada. Las conclusiones de la Comisi\u00f3n de\nInvestigaci\u00f3n de la Asamblea de Madrid son claras se\u00f1alando a los responsables pol\u00edticos;\nahora hace falta que esa responsabilidad se lleve al terreno judicial.<\/p>\n\n\n\n<p>SOLIDARIDAD\nOBRERA es oficialmente <strong>ACUSACI\u00d3N PARTICULAR<\/strong> en este proceso judicial, y\nse\u00f1alaremos las negligencias cometidas en torno a la manipulaci\u00f3n de materiales\ncon amianto, y pediremos que la justicia caiga con todo su peso sobre los\nresponsables, sobre TODOS LOS RESPONSABLES, y no s\u00f3lo sobre los que ejecutan\nlas directrices recibidas desde lo alto. As\u00ed lo entendimos desde el principio y\nhemos actuado en consecuencia. Lo que no imagin\u00e1bamos es que nos est\u00e1bamos enfrentando\na un juego de \u201cingenier\u00eda jur\u00eddica\u201d que la Direcci\u00f3n de Metro ha tramado,\nrechazando todo reconocimiento al riesgo y el envenenamiento, para protegerse\njur\u00eddicamente de m\u00e1s que posibles acusaciones.<\/p>\n\n\n\n<p>Ha\nllegado el momento de esclarecer lo sucedido, recordamos a la direcci\u00f3n de esta\nempresa que <strong>las relaciones con los sindicatos\nest\u00e1n rotas<\/strong> por <strong>NO APARTAR<\/strong> de sus cargos en PREVENCI\u00d3N y SALUD\nLABORAL a los ahora <strong>IMPUTADOS<\/strong>. No pueden mantener ni un segundo m\u00e1s a\nestas personas como responsables de proteger la salud y prevenir riesgos de los\ntrabajadores. De continuar en sus cargos ser\u00e1 una grave falta de respeto.<\/p>\n\n\n\n<p>Por si\ntodo lo ocurrido hasta la fecha no fuese lo suficientemente grave y\nescandaloso, SE EST\u00c1 QUEBRANTANDO EL ACUERDO PARA REALIZAR LOS <strong>TCAR<\/strong> a\nlos trabajadores expuestos desde hace d\u00e9cadas.
