Juan Antonio Gonz&aacute;lez S&aacute;nchez, en calidad de Secretario General de la Secci&oacute;n Sindical en Metro del <strong>Sindicato SOLIDARIDAD OBRERA<\/strong>, con domicilio a efectos de notificaci&oacute;n en c\/ Valderribas n&ordm; 49,<span>&nbsp; <\/span>2&ordm; izq., 28007-Madrid (Tel&eacute;fono:91-3798733) .<\/span><\/p>\n<p style=\"margin-bottom: 6pt; text-align: justify; line-height: 150%\" class=\"MsoNormal\"><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">Que por medio del presente escrito venimos a <strong>presentar denuncia<\/strong> ante esta Inspecci&oacute;n de Trabajo, <strong>contra la empresa METRO DE MADRID, S.A.<\/strong>, con domicilio a efectos de notificaci&oacute;n en c\/ Cavanilles n&ordm; 58, 28007-Madrid; en base a los siguientes,<\/span><\/p>\n<p style=\"margin: 12pt 0cm 6pt; text-align: center; line-height: 150%\" class=\"MsoNormal\" align=\"center\"><strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">HECHOS:<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 6pt; text-align: justify; line-height: 150%\" class=\"MsoNormal\"><strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">Primero.- <\/span><\/strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">Que el 9 de octubre del a&ntilde;o 2001, se firm&oacute; el convenio colectivo de la supracitada empresa y con vigencia desde su fecha hasta el 31 de diciembre del a&ntilde;o 2004.<\/span><\/p>\n<p style=\"margin-bottom: 6pt; text-align: justify; line-height: 150%\" class=\"MsoNormal\"><strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">Segundo.-<\/span><\/strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\"> Su cl&aacute;usula 16&ordf; titulada medidas de mejora en la organizaci&oacute;n del trabajo establece literalmente, para los trabajadores de las Unidades Operativa y del Puesto Central y Desarrollo T&eacute;cnico: &ldquo; Se limitar&aacute; la prolongaci&oacute;n de la jornada de trabajo por falta de relevo hasta un m&aacute;ximo de una hora diaria y hasta un total de dos veces al mes por agente, y sin que compute, a estos efectos el tiempo necesario para atender la llegada del &uacute;ltimo tren a las estaciones de cabecera &ldquo;<strong><\/strong><\/span><\/p>\n<p style=\"margin: 6pt 0cm; text-align: justify; line-height: 150%\" class=\"MsoNormal\"><strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">Tercero.-<\/span><\/strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\"> Que la empresa de manera interesada donde pone limitar&aacute;, entiende poder obligar a los trabajadores a prolongar su jornada una hora dos veces al mes, y as&iacute; a trav&eacute;s de los Jefes de L&iacute;nea est&aacute; obligando a los trabajadores a quedarse 1 hora en caso de falta de relevo.<span>&nbsp;&nbsp; <\/span><\/span><\/p>\n<p style=\"margin: 6pt 0cm; text-align: justify; line-height: 150%\" class=\"MsoNormal\"><strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">Cuarto.-<\/span><\/strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\"> Que adem&aacute;s los Jefes de L&iacute;nea al dar la orden al trabajador al que le falta el relevo le preguntan si desea quedarse voluntariamente, en cuyo caso esa ampliaci&oacute;n no computa a efectos de agotar el cupo mencionado de una hora dos veces al mes.<\/span><\/p>\n<p style=\"margin: 4pt 0cm 6pt; text-align: center; line-height: 150%\" class=\"MsoNormal\" align=\"center\"><strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">Por todo ello:<\/span><\/strong><\/p>\n<p style=\"margin-bottom: 6pt; text-align: justify; text-indent: 14.2pt; line-height: 150%\" class=\"MsoNormal\"><strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\">Le pedimos que<\/span><\/strong><span style=\"font-size: 14pt; line-height: 150%; font-family: Arial\"> teniendo por presentado este escrito, con sus copias, se sirva admitirlo, tener por formulada denuncia por los hechos expresados y, en consideraci&oacute;n con lo expuesto y tras los tr&aacute;mites oportunos, si as&iacute; lo estimase, procediese a estimar vulnerada la cl&aacute;usula 16 del convenio colectivo, obligando a la empresa a que cese en sus &oacute;rdenes de obligar a los trabajadores a quedarse 1 hora en caso de falta de relevo, y que en caso de ser totalmente indispensable la presencia de trabajadores en un puesto de trabajo, descarrilos, recuento de recaudaci&oacute;n, aver&iacute;as de se&ntilde;ales, y dem&aacute;s casos cuya realizaci&oacute;n sea necesaria para prevenir o reparar siniestros u otros dat&ntilde;os, se limite tal como establece la cl&aacute;usula 16 del convenio la prolongaci&oacute;n a una hora, dos veces al mes.<\/span><\/p>\n<p style=\"margin-bottom: 6pt;
